LAY-BY TERMS & CONDITIONS

Effective Date: February 2026

These Lay-By Terms & Conditions govern all lay-by transactions entered into with Hydromatic Technical Services & Supplies trading as Hydromatic Store (“Hydromatic”, “we”, “our”, “us”). By entering into a lay-by agreement, the customer (“you”, “your”) agrees to be bound by these terms.

1. What is Lay-By?

Lay-by is a payment arrangement whereby:

  • A customer selects goods,

  • Pays a deposit,

  • Pays the balance in instalments over an agreed period,

  • Receives the goods only after full payment has been made.

Ownership of goods remains with Hydromatic Store until full payment is received.

2. Eligibility

Lay-by is available to:

  • Individuals aged 18 years and above

  • Customers with valid identification

  • Customers who agree to provide accurate contact details

Hydromatic reserves the right to approve or decline any lay-by request at its sole discretion.

3. Deposit Requirement

  • A minimum deposit of 30% of the total purchase price is required to initiate a lay-by.

  • The deposit secures the goods and confirms the lay-by agreement.

  • The lay-by period begins from the date of deposit payment.

Hydromatic reserves the right to require a higher deposit depending on the product category.

4. Lay-By Period

  • Standard lay-by period: 90 days, unless otherwise agreed in writing.

  • The full balance must be paid within the agreed lay-by period.

  • No goods will be released until payment is made in full.

 

5. Instalment Payments

  • Instalments may be paid weekly, bi-weekly, or monthly.

  • Payments must be made using approved payment methods (Cash, Mobile Money, Bank Transfer, In-Store Payment).

  • Customers must quote their Lay-By Reference Number with every payment.

Failure to make regular payments may result in cancellation and/or penalisation.

6. Pricing

  • The price of goods is fixed at the time the lay-by is initiated.

  • No additional interest is charged unless otherwise agreed.

  • Promotional prices may not apply to lay-by transactions unless specifically stated.

Hydromatic reserves the right to exclude certain discounted or clearance items from lay-by.

7. Cancellation by Customer

If the customer cancels the lay-by:

  • A cancellation fee of up to 10% of the total purchase price may apply.

  • Administrative and processing costs may be deducted.

  • The remaining balance (after deductions) will be refunded within 7–14 working days.

Refunds will be processed via the original payment method where possible.

 

8. Failure to Complete Lay-By

If full payment is not made within the agreed period:

  • Hydromatic may cancel the lay-by without further notice.

  • A cancellation fee (as stated above) may apply.

  • Any balance remaining after deductions will be refunded.

Hydromatic reserves the right to resell the goods after cancellation.

 

9. Storage & Risk

  • Goods remain the property of Hydromatic Store until fully paid.

  • Goods are stored at the customer’s risk after the agreed lay-by period expires.

  • Hydromatic is not responsible for delays caused by force majeure events (e.g., fire, flood, unrest, supply chain disruptions).

 

10. Non-Transferability

Lay-by agreements:

  • Are non-transferable.

  • Cannot be assigned to another person without written consent from Hydromatic.

 

11. No Exchanges During Lay-By

  • Goods under lay-by may not be exchanged for different items unless agreed by management.

  • If a customer wishes to change products, a new lay-by agreement may be required.

 

12. Warranty

  • Warranty period begins on the date goods are collected (not deposit date).

  • Standard Hydromatic Warranty Terms apply.

 

13. Collection of Goods

  • Goods must be collected within 7 days of full payment.

  • Valid identification may be required at collection.

  • A signed delivery/collection note will confirm transfer of possession.

 

14. Limitation of Liability

Hydromatic’s maximum liability under any lay-by agreement shall not exceed the total amount paid by the customer.

Hydromatic shall not be liable for indirect or consequential losses.

 

15. Governing Law

These Terms & Conditions are governed by the laws of the Republic of Zambia.
Any disputes shall be subject to the jurisdiction of Zambian courts.
